The Planning Services Manager presented the application for installation of a domestic sewage treatment plant to replace the septic tank on the land adjoining Fishponds Cottages, Barley Lane (HS/FA/19/00871).
The Planning Services Manager explained that the application was submitted to the committee because the applicant is an employee of Hastings Borough Council in a restricted post.
Councillors were shown plans and drawings of the application site. A revised drawing showing a new outlet with a sample point was submitted on 14th January 2021. The position of the discharge pipes was slightly changed. No additional comments or objections have been received as a result of further consultation on the revised drawing. An amended application form with a certificate of ownership and notices served on interested parties was submitted on 10th December 2020.
Councillors were updated on the location of the application site. The area is generally rural in character and partially located within an Area of Outstanding Natural Beauty, Local Nature Reserve and Local Wildlife Site. The edge of the application site is within ancient woodland and a Site of Special Scientific Interest (SSSI).
The sewage treatment plant would replace the existing failing septic tank and incorporates a sampling point. The plant will treat foul water coming from the cottages to ensure that when the water leaves the discharge pipe it will not be a pollutant.
The Planning Services Manager confirmed that the existing septic tank will be removed and that the applicant has already applied to the Environment Agency for permission to install the sewage treatment plant. The Environment Agency will monitor the impact of the new treatment plant on the local environment.
Councillor Bishop proposed approval of the recommendations, seconded by Councillor Cox
RESOLVED (unanimously) that full planning permission be granted subject to the following conditions:
1. The development hereby permitted shall be begun before the expiration of
three years from the date of this permission.
2. The development hereby permitted shall be carried out in accordance with
the following approved plans:

3. With the exception of internal works the building works required to carry out
the development allowed by this permission must only be carried out within
the following times:
08.00 - 18.00 Monday to Friday
08.00 - 13.00 on Saturdays
No working on Sundays or Public Holidays.
4. No development shall take place (including any demolition, ground works or
site clearance) until a Method Statement for the protection of Ancient
Woodland, Great Crested Newts, and badgers, and the reinstatement of the
Local Wildlife Site, has been submitted to and approved in writing by the
Local Planning Authority. The content of the Method Statement shall include
the following:
a) Purpose and objectives for the proposed works
b) Detailed design(s) and/or working method(s) necessary to achieve
stated objectives (including, where relevant, type and source of
materials to be used)
c) Extent and location of proposed works shown on appropriate scale
maps and plans
d) Timetable for implementation, demonstrating that works are aligned
with the proposed phasing of construction
e) Persons responsible for implementing the works
f) Initial aftercare and long-term maintenance (where relevant)
g) Disposal of any wastes arising from the works
h) Full details on the extent of the work required to extend the discharge
pipe to Fishponds Gill
The works shall be carried out in accordance with the approved details,
before the use of the sewage treatment plant hereby approved commences.
The approved works shall be retained and maintained in accordance with the
approved Method Statement thereafter.
Reasons:
1. This condition is imposed in accordance with the provisions of Section 91 of
the Town and Country Planning Act 1990.
2. For the avoidance of doubt and in the interests of proper planning.
3. To safeguard the amenity of adjoining residents.
4. To protect habitats from adverse impacts during construction and to avoid an offence under the Wildlife and Countryside Act 1981, the Protection of
Badgers Act 1992 and the Conservation of Habitats and Species Regulations 2017.
Notes to the Applicant
1. Failure to comply with any condition imposed on this permission may result
in enforcement action without further warning.
2. Statement of positive engagement: In dealing with this application Hastings
Borough Council has actively sought to work with the applicant in a positive
and proactive manner, in accordance with paragraph 38 of the National
Planning Policy Framework.
3. The applicant is advised that they must ensure the proposed works, hereby
approved, do not contravene laws protecting wildlife including the
Countryside and Wildlife Act 1981. Where the applicant is in doubt they
should contact Natural England on wildlife@naturalengland.org.uk

any works.
4. There may be badgers on or near the application site, and your attention is
drawn to the provisions of the Badger Protection Act 1992. It is a criminal
offence to kill or injure a badger; to damage or obstruct access to its sett; or
to disturb a badger when it is occupying a sett.
5. To comply with Condition No. 4 above the applicant must consult the
Borough Arboriculturist (telephone: 01424 451147).
6. The applicant is required to consult with the land drainage team to discuss
whether the works to establish an outfall from the package treatment works
into the watercourse will require ordinary watercourse consent. The applicant
should contact the Local Lead Flood Authority at
watercourse.consenting@eastsussex.gov.uk
7. The applicant is advised that should protected species be encountered
during development, work should stop with immediate effect, and advice
should be sought from a suitably qualified and experienced ecologist on how
to proceed.
8. The applicant is advised that they must seek SSSI consent from Natural
England prior to any development taking place (including any demolition,
ground works or site clearance).
