Public Consultation
Yes – Application by serving employee in restricted post
The Planning Services Manager presented the application for installation of a domestic sewage treatment plant to replace the septic tank on the land adjoining Fishponds Cottages, Barley Lane (HS/FA/19/00871).
The Planning Services Manager explained that the application was submitted to the committee because the applicant is an employee of Hastings Borough Council in a restricted post.
Councillors were shown plans and drawings of the application site. A revised drawing showing a new outlet with a sample point was submitted on 14th January 2021. The position of the discharge pipes was slightly changed. No additional comments or objections have been received as a result of further consultation on the revised drawing. An amended application form with a certificate of ownership and notices served on interested parties was submitted on 10th December 2020.
Councillors were updated on the location of the application site. The area is generally rural in character and partially located within an Area of Outstanding Natural Beauty, Local Nature Reserve and Local Wildlife Site. The edge of the application site is within ancient woodland and a Site of Special Scientific Interest (SSSI).
The sewage treatment plant would replace the existing failing septic tank and incorporates a sampling point. The plant will treat foul water coming from the cottages to ensure that when the water leaves the discharge pipe it will not be a pollutant.
The Planning Services Manager confirmed that the existing septic tank will be removed and that the applicant has already applied to the Environment Agency for permission to install the sewage treatment plant. The Environment Agency will monitor the impact of the new treatment plant on the local environment.
Councillor Bishop proposed approval of the recommendations, seconded by Councillor Cox

Proposal
Change of use to a flexible use of Class E (commercial and service) and Sui generis (takeaway)
Application No

Public Consultation
Yes – Council application on Council owned land
The Planning Services Manager presented the application for a change of use to a flexible use of Class E (commercial and service) and Sui generis (takeaway) of store 4, Bottle Alley, St Leonards on Sea (HS/FA/20/00688)
Councillors were shown plans and photographs of the store.
There were no external alternations to the site proposed in the application. The proposal for a flexible use will enable any of the proposed uses to be implemented, or changed to, within a ten-year period without the need for multiple planning permissions. The use in operation at the end of the ten-year period becomes the lawful use of the property from that date onwards.
Proposed uses within Class E are E(a) retail; E(b) café or restaurant; E(d) indoor sport/recreational fitness; and a sui generis takeaway. If the kiosk is to be used to serve food it is required to be pre-cooked off site so that an extractor fan is not necessary.
Other possible uses within Class E were not considered acceptable as they have no direct connection to, and do not enhance, the leisure and recreation aspect associated with the seaside location. What is more, they are identified as more vulnerable uses for flooding and therefore not permitted in a Flood Zone 3a without additional permissions.
Councillors debated the proposal.
Councillor Roberts proposed approval of the recommendation, seconded by Councillor O’Callaghan
RESOLVED (unanimously) that full planning permission be granted subject to the following conditions:
1. The development hereby permitted shall be begun before the expiration of

3. The premises shall not be used except between the following hours:
05:00 - 23:00 Monday - Friday,
05:00 - 23:00 Saturdays,
05:00 - 23:00 Sundays or Bank Holidays.
Any proposed changes to the above opening times shall be submitted and
approved by the Local Planning Authority.
4. The hereby approved flexible use of the premises excludes the following
uses:
Class E(c), Class E(e), Class E(f) and Class E(g).
5. Any retail (Class E(a)) use implemented on site should be of a mixed use
with a clear connection to leisure and recreation activities.
